Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period:
The period during which the consumer may exercise the right of withdrawal;

Consumer:
A natural person acting for purposes outside their trade, business, or profession who enters into a distance contract with the entrepreneur;

Day:
Calendar day;

Continuous transaction:
A distance contract relating to a series of products and/or services whose delivery or performance is spread over time;

Durable data carrier:
Any medium that enables the consumer or entrepreneur to store information in a way that allows future access and unchanged reproduction;

Right of withdrawal:
The consumer’s right to withdraw from the distance contract within the legally applicable period;

Entrepreneur:
The natural or legal person offering products and/or services to consumers via distance selling;

Distance contract:
A contract concluded without the simultaneous physical presence of the entrepreneur and the consumer, using means of distance communication;

Means of distance communication:
Any means that can be used to conclude a contract without the entrepreneur and consumer being in the same place at the same time;

Terms and Conditions:
These general terms and conditions.


Article 2 – Applicability

These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated where the Terms and Conditions can be reviewed and that they will be provided free of charge upon request.

For electronically concluded contracts, these Terms and Conditions will be made available in a manner that allows them to be stored on a durable data carrier.

If, in addition to these Terms and Conditions, specific product or service conditions apply, the provision most favorable to the consumer shall prevail in the event of a conflict.


Article 4 – The Offer

If an offer has a limited validity period or is subject to conditions, this will be clearly stated.

All offers are non-binding. The entrepreneur reserves the right to modify offers.

The offer contains a complete and accurate description of the products and/or services offered.

Product images are for illustrative purposes only. Obvious errors or mistakes do not bind the entrepreneur.


Article 5 – The Contract

The contract is concluded at the moment the consumer accepts the offer and complies with the stated conditions.

For electronically concluded contracts, the entrepreneur will promptly confirm receipt of the acceptance.

Until this confirmation has been received, the consumer has the right to terminate the contract.


Article 6 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 14 days, without stating reasons.

This period commences on the day following receipt of the product by the consumer.


Article 7 – Costs in Case of Withdrawal

If the consumer exercises the right of withdrawal, the direct costs of returning the goods shall be borne by the consumer.


Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for certain products, provided this is clearly stated in the offer.


Article 9 – Price

Prices will not be increased during the validity period of the offer, except in the event of changes in applicable tax rates.


Article 10 – Conformity and Warranty

The entrepreneur guarantees that the products delivered comply with the contract, the description in the offer, and applicable legal requirements.


Article 11 – Delivery and Performance

The entrepreneur shall exercise the utmost care in the fulfillment and delivery of orders.


Article 12 – Continuous Transactions: Termination

The consumer may terminate a contract of indefinite duration at any time, subject to a notice period of no more than one month.


Article 13 – Payment

Unless otherwise agreed, payment must be made within 7 business days after the start of the cooling-off period.


Article 14 – Complaints

Complaints must be submitted within 7 days after the defect has been identified.


Article 15 – Applicable Law and Jurisdiction

These Terms and Conditions and all agreements concluded on their basis are governed by applicable international laws and regulations. Any disputes shall be subject to the jurisdiction of the entrepreneur, unless mandatory consumer protection laws in the consumer’s country of residence provide otherwise.
